Terms and Conditions

Bungalows

1. General
Costalingua S.A. lets rental objects to private persons for holidays at Beach Resort La Margarita. Beach Resort La Margarita is is registered in the tourism establishments register of Catalonia with Nr. ATT-000033.

2. Booking and Payment
Available rental properties may be booked through the Internet, on the web site www.costalingua.biz. Reservations may also be placed by telephone or in person. The payment of the total amount by credit card, via bank transfer, or in cash, constitutes the final and binding reservation. Until the payment transaction is completed the rental object will appear as available for booking on the internet. If a payment occurs via bank transfer, the reservation will become final as soon as at least 50% of the total amount has been posted onto the bank account of Costalingua S.A., provided that the rental object is still available. Upon receipt of the payment by Costalingua S.A. the reservation of the rental object will be binding for both parties, provided the rental object is still available. If the rental object is no longer available, the client will be informed immediately and the paid amount will be refunded within one week.

3. Cancellation and Refund Policy
Once the balance is received by Costalingua S.A. the reservation becomes final and binding for both parties, i.e. the customer and Costalingua S.A. Should the client decide to cancel the reservation, the following cancellation and refund policy shall apply:

- Over 90 days before the start of the stay: 70% of the paid amount will be refunded.
- 60 - 90 days before the start of the stay: 50% of the paid amount will be refunded.
- Less than 60 days before the start of the stay: no refund.

The cutoff day refers to the date of receipt of the cancellation letter or email by Costalingua S.A. All cancellations must be communicated in writing.

4. Travel cancellation insurance
In order to cover the cost of a possible cancellation, we recommend contracting travel insurance, e.g. ELVIA travel cancellation insurance, as well as travel medical insurance.

5. Liability of Costalingua S.A.
Costalingua S.A. is responsible for the accurate description of the advertised rental objects on the internet, for the correct processing of customers’ reservations, as well as for the proper delivery of the advertised services. Costalingua S.A. shall be liable neither for temporary disruptions in water and electrical power supply, nor for damages in or around the bungalows, which were incurred due to grossly negligent behavior of guests, nor for any natural occurrences on site. Costalingua S.A. shall be liable neither for any accidents clients may incur inside or outside of the rental objects, nor for accidents which are not demonstrably due to faulty appliances or poor building conditions.

6. Guarantees
Should a service not be delivered according to the terms described on the internet site, the customer may ask for resolution of the problem. The complaint must be raised immediately upon the occurrence, resp. upon noticing the fault in question. Costalingua S.A. is committed to providing a solution of equal value. However, the provision of such a compensatory service may be denied if this entails a disproportionate effort.

7. Obligations of the tenant
The rental objects shall be occupied by max. four (4) people. Occupancy by more than four people requires prior permission by Costalingua S.A.

The client is responsible for treating the furniture and any equipment in and around the rental objects with due care. The client must notify Costalingua S.A. management immediately about any defaults and damages. Furthermore, the client must notify Costalingua S.A. management of all damages and losses he or she has caused during his or her stay in the rental property.

For the coverage of potential damages all guests are required to leave a deposit of EUR 200.00 at check-in on the premises. This deposit will be refunded at check-out after deduction of all applicable damage costs.

The tenant is personally liable for damages he or she has caused. Costalingua S.A. reserves the right to charge clients for damages or for items missing after the client’s departure. If the client has a personal and/or general household liability insurance policy, please note that these insurance policies usually do not cover damages caused to rental objects, unless you have made special provisions.

Should there be an impairment or disruption of any service delivery, the client is required to contribute, within the boundaries of all applicable legal regulations, to the elimination of said impairment or defect, and to minimize damages which may have resulted. Notably, the client must communicate his or her complaints to Costalingua S.A. management during his or her stay immediately upon noticing a defect. Otherwise the client will lose all entitlement to a possible refund.

8. Safety and quiet
All clients at La Margarita would like to enjoy a relaxing and untroubled holiday. Therefore, the safety and well-being of all clients have highest priority. All clients are expected to behave in a respectful and civilized manner. To protect the safety of clients, the grounds of La Margarita will remain locked and can only be accessed by registered clients.

The maximum occupancy of the bungalows is 4 people. Exceptionally and with prior permission by Costalingua S.A. management, 5 people may be allowed in one bungalow, especially in case of families with children. More than 5 people are not allowed in one bungalow under any circumstances.

The number indicated by the client in the reservation must not be exceeded. At check-in there will be a mandatory registration of all clients’ personal data, which according to the law in Catalonia must be recorded in the official online police database. In addition, the registration of all clients is necessary for the correct payment of the tourist tax to the local tax authorities (this tax is already included in the rental price). Therefore, all clients over 14 years of age who spend the night in a bungalow must be prepared to produce a valid ID or passport. Children under 14 years of age will be registered, too, but do not require ID.

9. Visitors
Clients at La Margarita value peace and quiet above all during their holiday. Their needs have highest priority at all times. Visitors are welcome but must be previously announced at reception by their hosts staying at La Margarita and must personally announce themselves at reception. Visits of a few hours will be free of charge. Like all clients, visitors are equally expected to behave in a respectful and civilized manner. Clients staying in the bungalows are liable for any damages or disturbance caused by their visitors.

Under no circumstances are visitors allowed to spend the night in the bungalows.

10. Vehicles
Per rented house there will be one (1) vehicle allowed on the premises of La Margarita. Parking additional cars, caravans, mobile homes, trailers and other utility vehicles requires prior permission by Costalingua S.A. management.

11. Animals
With prior permission by Costalingua S.A. clients are allowed to bring one (1) dog per bungalow. It will be the dog owner’s responsibility to ensure that the dog does not bother other guests in any way. The dog owner must be prepared to take the dog on a leash or to tie it if necessary. It is forbidden to leave dogs alone in the bungalow. Dog owners are liable for any damages and/or injuries caused by their dogs to things and people within the premises of La Margarita. Costalingua S.A. reserves the right to expel clients with disruptive or annoying dogs from La Margarita without refund after two verbal warnings

12. Arrival / Departure
On arrival day the rental objects can be entered from 4:00 pm. On departure day the rental objects must be vacated by 11:00 am. at the latest. Exceptions to this policy may be granted only upon prior agreement and explicit approval of Costalingua S.A. management.

13. Other provisions
Court of jurisdiction for the above terms and conditions is Reus (Tarragona), Spain.


Language Courses

1. Costalingua offers the following types of language courses
- Intensive courses: Monday to Friday, in 3 different intensities: „Relax“ (2h/day), „Standard/Business“ (4h/day), „Intensive“ (5 h/day) over a chosen number of weeks with a timetable defined by Costalingua.
- Trimester courses: 1-2 h/week during one trimester, with a timetable defined by Costalingua.
- Individual courses (for 1, 2 or 3 people), lessons scheduled jointly by the participant/s and Costalingua.

2. Terms of payment
- Placement test and registration are free. For intensive courses (“Relax” with a duration of 2 weeks and longer) and for trimester courses with a course fee of min. 300 EUR the course material/book shall be included in the course fees. For shorter courses, resp. for courses with course fees of less than 300 EUR there will an additional fee of 15-25 EUR for the book/material will be charged.
- Fees for intensive courses and trimester courses shall be paid in advance. A payment scheme in instalments may be agreed with Costalingua.
- The fees for individual courses shall be paid either in advance for a certain number of hours or before the start of each lesson.

3. Withdrawal before course start
- If Costalingua withdraws, i.e. if Costalingua does not deliver a course that has already been paid by the student, the student shall be entitled to a complete refund of the paid amount.
- If the student withdraws before starting the course, i.e. if the student informs Costalingua that he/she will not attend the course he/she has registered for and paid for, he/she shall be entitled to a refund of the paid course fees, less all processing costs which may be incurred by Costalingua, such as for bank transfers, credit card fees, etc.

4. Withdrawal or transfer to other course after course start
- If Costalingua withdraws during an ongoing course period, i.e. if Costalingua discontinues a course that a student has already paid for, or if Costalingua expels a student from a course, the student shall be refunded the corresponding pro-rata amount he/she has paid in excess, less the price of the course material/book (15-25 EUR).
- If a student withdraws during an ongoing course, i.e. if he/she stops attending classes, he/she shall be refunded the corresponding pro-rata amount he/she has paid in excess, less the price of the course material/book (15-25 EUR) and all processing costs which may be incurred by Costalingua, such as for bank transfers, credit card fees, etc.
- If the student transfers to another course in agreement with Costalingua (e.g. change of level or change of intensity) after the start of a course, he/she shall be refunded the corresponding pro-rata amount he/she has paid in excess, less the price of the course material/book (15-25 EUR) and all processing costs which may be incurred by Costalingua, such as for bank transfers, credit card fees, etc.

5. Absences policy
- If a student fails to attend a single session of a trimester course or of an intensive course, he/she shall not be entitled to a refund nor to a compensation of the missed lesson(s). Costalingua may offer the student to attend a session of another trimester course or intensive course depending on availability.
- Individual courses are scheduled jointly by Costalingua and the participant(s) and may be cancelled or rescheduled by either party up to 2 hours before the scheduled course time. If a student cancels on short notice or misses class unexcused, the student shall be billed for the missed lesson.

6. Absences of teachers
All language courses are delivered by qualified teachers. In case a teacher is unable to deliver a class, Costalingua shall provide one of the following solutions:
1) Whenever possible, Costalingua shall provide a suitable replacement to deliver the classes in question.
2) Should the above mentioned option 1) not be feasible, Costalingua will schedule one or more sessions (corresponding to the missed time) with the group to compensate for the missed class(es).
3) Should none of the above mentioned options be feasible, the students shall receive a partial refund or shall have part of the course fee credited to a subsequent course.

7. Public holidays
Class sessions which fall on a local/national public holiday shall take place on that same day. They may be postponed to another date upon the students’ requests only if this can be mutually agreed upon by the entire group and the teacher.

8. Attendance certificates
All students who complete an intensive or trimester course shall receive an attendance certificate at the end of the course which details their progress and objectives met, and which provides recommendations for follow-up.
